O R D E R
By Hon’ble Mr. Manish Garg, Member (J):
In the present Original Application (OA) filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:–
“(a) To quash and set aside the impugned Detailed Medical Examination (DME) report dated 04.05.2017 and the Review Medical Examination (RME) report dated 20.07.2017, whereby the applicant has been declared medically unfit on the grounds of “defective distant vision” and “overweight”;
(b) To direct the respondents to constitute an independent medical board to re-examine the applicant in accordance with the prescribed medical standards;
(c) To declare the applicant medically fit, if found so upon re-examination, and consequently direct the respondents to appoint the applicant to the post of Sub-Inspector in CAPFs/Delhi Police;
(d) To grant all consequential benefits, including seniority and notional benefits, from the date persons similarly situated were appointed;
(e) To pass any other or further order(s) as this Hon’ble Tribunal may deem fit and proper in the facts and circumstances of the case.”
