ORDER

Hon’ble Mr. Manish Garg, Member (J) :

1.This is a remand case. Earlier, this Tribunal vide order dated 15.02.2021 disposed of the Original Application after observing that the respondent authorities had conducted a common examination for the posts of Assistant Primary Teacher (Nursery) under Post Code 68/10 in the Municipal Corporation of Delhi and Assistant Teacher (Nursery) under Post Code 03/13 in the Directorate of Education, GNCTD. During the course of selection, disputes arose regarding preparation of separate merit lists and the appointment of candidates against both post codes. The Tribunal noted that corrective steps had subsequently been undertaken by the respondents and that most of the applicants had already been selected and appointed. Insofar as applicant no.3, namely Uma, was concerned, this Tribunal observed that she had lost selection on account of a tie in marks and accordingly directed the respondents that, in case one vacancy under the UR category for Post Code 68/10 was available, her candidature be considered for appointment, if not already appointed. The OA was accordingly disposed of.
