1.The present Original Application has been filed by the applicant praying for the following reliefs: -

“It is therefore prayed that the impugned order dt. 06.03.2024 may kindly be quashed and set aside. The respondents should be directed not to fill the promotion quota vacancies of LDC from 08.06.2013 to 14.01.2015 as per RRs of LDC dt. 08.06.2013. Any other direction which this learned Tribunal deems fit in the facts and circumstances may kindly be passed in favour of the applicants.”

2. The brief facts of the case, as stated by the applicants are that they were initially appointed as Sepoy/Hawaldar and later on promoted to the post of LDC and thereafter as Tax Assistant and Executive Assistant. The respondent- department issued recruitment rules namely Ministry of Finance, Department of Revenue, Central Excise and Customs (Lower Division Clerk) Recruitment Rules, 2013 (Annexure A/3); as per which Sepoy/Hawaldar/MTS who had rendered 03 years of regular service in the grade after appointment thereto on regular basis on the basis of the departmental qualifying examination were eligible for promotion to the post of Lower Division Clerk (LDC).
