Heard Ld. Counsel on both the sides.

2. This application has been taken up by the Single Bench

in accordance with the order of the Hon’ble Chairman, Central

Administrative Tribunal dated 10.09.2021 issued under Sub-

section (6) of Section 5 of the Administrative Tribunals Act,

1985 and since no complicated question of law is involved.

3. At hearing, Ld. Counsel for the respondents submitted

that he does not wish to file a reply in this matter and that his

oral submissions may be taken into consideration.

Furthermore, since the identical questions of fact and law are

involved, the present O.A. has been taken up for final disposal

at the stage of admission itself with the consent of Ld. Counsel

for both the parties. The applicant has sought the following

relief under Section 19 of the Administrative Tribunals Act,

1985:-

“a. A direction upon the concerned respondent authorities i.e.

respondent nos. 2 and 3 to recall and/or withdraw the impugned

Memorandum dated 30.12.2025 (Annexure "A-1") issued by

Respondent No. 3, and Speaking Order dated 26.02.2026 (Annexure

"A-10") issued by Respondent No. 2 whereby the Applicant has been

sought to be prematurely retired from service on attaining the age of

58 years, being illegal, arbitrary and contrary to the applicable

service rules.

b. An order be passed quashing and/or set aside impugned

Memorandum dated 30.12.2025 (Annexure "A-1") issued by

Respondent No. 3, and Speaking Order dated 26.02.2026 (Annexure

"A-10") issued by Respondent No.2.
