ORDER

Per : Hon’ble Shri Lok Ranjan, Member (A)

1.The present Original Application had been filed against the impugned order dated 26.06.2012 of the Superintendent (Sorting), Jaipur RMS i.e. Respondent No.4 for treating the period of absence of 25 days from 21.01.2012 to 14.02.2012 of the Applicantto beas unauthorized absence and thus to be ‘Dies-Non’ under Rule-162 and Rule-62 of the Postal Manual Vol.III ; while prescribing that no pay and allowances shall be admissible to him for those days, which will however not be treated as break in service – without prejudice to any other action against him for the said irregularities. The Applicant was also aggrieved by the Memo dated 30.05.2016 vide which his appeal against the said ‘Dies- Non’ order dated 26.06.2012 had been disposed of by the Sr. Superintendent RMS, Jaipur Division i.e. Respondent No.3, while deciding that there was no merit/ground to intervene.

2. This was a second round of litigation in respect of this matter. The Applicant had previously filed the O.A. No. 196/2016 before this Tribunal, which had been decided vide Order dated 31.03.2016, inter alia as follows –
