1.The present Original Application has been filed by the applicant seeking extension of the benefit of the judgment dated 13.01.2004 passed by this Tribunal in OA No. 1464/2003 titled Ashok Kumar & Ors. v. Union of India & Ors.

2. The brief facts of the case, as enumerated by the learned counsel for the applicant, are that the applicant initially joined service under the respondents as a Lab Attendant on 10.04.1986. During the course of his service, he discharged duties pertaining to laboratory work under the Central Government Health Scheme (CGHS). The applicant was subsequently granted financial upgradation under the Assured Digitally signed by Career Progression Scheme (ACP) in the pay scale of RACHNA KAPOOR RACHNA KAPOOR Rs. 3200–4900 in the year 2001. Learned counsel for the applicant submitted that pursuant to the recommendations of the 5th Central Pay Commission, the pay scale attached to technical posts requiring matriculation with experience and Diploma in Medical Laboratory Technology was revised from Rs. 3200– 4900 to Rs. 4000–6000.
