PER: HON’BLE MR. VARUN SINDHU KUL KAUMUDI, ADMINISTRATIVE MEMBER
1. The present Original Application has been filed by the Applicants under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:
“...to quash and set aside impugned letter of 3rd Respondents dated 26.09.2023 as it is illegal, arbitrary, and against Railway Board Rules in force but also violation of Art 14, 16, 21 of the Constitution of India and direct the Respondents No.1 to consider the applicant’s son (Applicant No.2) Shri S.Venkata Rajesh Kumar for appointment under compassionate grounds on the strength of (1) Expert Medical body Opinion & (1) Railway Board Lt. No.E(NG)III/78/RC 1/1 Dt.30.04.1979 and (2) Railway Board letter No.E(NG)II/95/RC-1/94 dated 14.06.2006 (RBE No.78/06) and pass such other order/orders as this Hon’ble Tribunal deems fit and proper in the interest of principles of natural justice.”
2. The facts of the case, as per the Applicants, are summarised below:-
i. The applicant was appointed, initially, as a Commercial Booking Clerk, in the scale of Rs.260-400 / Rs.1320-2040(Rs), in the Vijayawada Division of the South Central Railway, during the year 1985. He
