An Original Application (O.A.) No. 1122/2025 was filed by the applicants under section 19 of the Administrative Tribunals Act, 1985. The facts of the case as averred in the said O.A. are as under:-

1.1 A Scheme was sanctioned by the Government of Jammu and Kashmir in 2009 for Return and Rehabilitation of Kashmiri Migrants to Kashmir Valley in accordance with the Package of the Prime Minister. As per the Scheme, employment opportunities were to be given to 15000 unemployed migrant youth, out of which 6000 youth were to be accommodated in State Government jobs. In order to assist the State Government in providing these opportunities, the Central Government was to bear the cost towards salary for 3000 youth till they were absorbed against regular posts in the State Government within the specified time frame. In furtherance to the said Scheme, SRO-412 dated 30.12.2009 was issued whereby the Jammu and Kashmir Kashmiri Migrants (Special Drive) Recruitment Rules, 2009 (hereinafter called “2009 Rules”) were framed.
