Claims for seniority must be raised within a reasonable time; delayed challenges to settled seniority lists, especially those based on prior judicial mandates, are not maintainable.
Headnote:The applicants challenged the rejection of their representations regarding the recasting of seniority lists for the post of Goods Guard. The applicants, appointed as Guard 'C' in 1990, alleged that juniors appointed in 1991 were placed above them in the seniority lists published on 30.12.2003 and 06.05.2005. The court found that the seniority lists were revised to give effect to previous judicial mandates in OA No. 842/1995 and WP No. 1524/2001. The primary issue was whether the seniority lists were incorrectly recast and whether the applicants were entitled to seniority over those appointed later. The court reasoned that the seniority lists were modified in accordance with the directions of the Tribunal and the High Court, and that the applicants failed to challenge the lists within the prescribed time limit of four months as per administrative guidelines, making the claim time-barred. Accordingly both OAs are dismissed.

In OA No. 597/2015, the applicant is challenging the order
dated 28.01.2015 (Annexure A-6) whereby his representation has
been rejected challenging the improper and incorrect recasting of
challenging het seniority position of Guard 'C' re-designated as
Goods Guard vis-a-vis his juniors. The applicant was appointed
as Commercial Clerk in Western Railway by an order dated
25.01.1985. Thereafter, he appeared in the Limited Departmental
Competitive Examination (LDCE) as Guard 'C' held on
25.01.1990. A list was issued on 22.10.2003 in two parts i.e. ‘A’
and ‘B’ wherein the name of the applicant was at Sl. No. 3 of list
'B' however the name of his juniors namely Shri Bhagchand
Sabnani and Shri Jitendrapal
