M.A. No.1998/2026 (Joining Together) is

allowed and the applicants are permitted to pursue

the matter jointly.

O.A. No. 1525/2026

In the present Original Application filed under

Section 19 of the Administrative Tribunals Act, 1985,

the applicants seek the following reliefs:-

“(i) To direct the respondent consider the name of the

applicant in eligible candidate list and permit the applicant

to appear in the exam scheduled to be held on

26.04.2026, 01.05.2026 and 03.05.2026 on provisionally

basis subject the outcome of the OA and subsequently

quash and set-aside the impugned Order dated

01.09.2015

(ii) any other relief: which this Hon'ble Tribunal may deem

fit, just and proper in the circumstances of the case, may

also be passed.

(iii) cost of the present case may be awarded in favor of

the Applicant and against the Respondents.”

2. Highlighting the prayers made in the present

Original Application, learned counsel for the

applicants submits that vide order dated 21.04.2026,

the applicants were permitted to participate in the

selection process for promotion to the post of Chief

Loco Inspector.

3. Learned counsel for the respondents submits

that the applicants have been allowed to participate in

the selection process and the final result of the

selection process has not yet been declared.

4. Be that as it may, since the applicants have

already been permitted to participate in the selection

process, we deem it appropriate to direct the

respondents to declare the result of the applicants

along with the results of other eligible candidates.

5. It is, however, made clear that the declaration of

the result of the applicants pursuant to the aforesaid

directions shall not confer any right or equity in his

favour. The issue as to whether the applicants would

be entitled to any benefit arising out of such

provisional participation shall be considered at the

appropriate stage, and the present order shall not be

construed as an expression of opinion on the merits of

the case.

6. Accordingly, the present Original Application

stands disposed of without prejudice to the rights and

contentions of either party. The case of the applicants

shall be considered by the respondents in accordance

with law. It is further clarified that the present order

shall not be treated as a precedent.

8. Pending Miscellaneous Applications, if any,

shall also stand disposed of. There shall be no order
