The Tribunal directed the competent authority of the respondents to consider and decide the applicant's pending representation for compassionate appointment within a period of 90 days.

ORAL ORDER

The present Original Application has been filed by the applicant under Section 19 of the Administrative Tribunal’s Act, 1985 by raising a grievance that the respondents are not considering the case of the applicant for Compassionate Appointment on the death of her husband on 01.01.2018.

It is the case of the applicant that in earlier round of litigation, the applicant has approached this Tribunal by filing OA No. 850/2025 which was disposed of by this Tribunal vide order dated 28.01.2026 by issuing following directions:

"In this view of the matter, I find that the applicant is entitled to family pension. Hence, the order:-

(i) Original Application is allowed with no order as to costs.

(ii) The respondents are directed to grant family pension to the applicant.

(iii) This exercise shall be done within a period of four months from the date of receipt of a certified copy of this order.

(iv) Pending MAs, if any, stand closed."

It is submitted that thereafter representation dated 15.02.2026 (Annexure-A-20) was submitted by the applicant in respect of grant of Compassionate Appointment to the applicant.

The respondents have issued communication dated 09.10.2025 (Annexure-A-1), in which it has been stated that the case for grant of Compassionate Appointment is under process.

Taking into consideration the aforesaid communication and pending representation, it is submitted that in the interest of justice, direct the Competent Authority of the respondents to consider the pending representation of the applicant dated 15.02.2026 (Annexure-A-20) within a time bound manner.

Considering the limited prayed made by the learned counsel for the applicant, the present Original Application is disposed of with the direction to the Competent Authority of the respondents to consider and decide the pending representation dated 15.02.2026 (Annexure-A-20) within a period of 90 days from the date of receipt of certified copy of the order.

Since the original application is disposed of, at admission stage itself and therefore, this Tribunal is not issuing any notice to the respondents.
