Whereas, SBSR, Tata Power Delhi Distribution Company Limited (TPDDL) (in Petition No. 235/MP/2023), has filed the cross-petition. Brief facts of the petition are as under:

a) The Ministry of Power issued Guidelines for Tariff-Based Competitive Bidding Process for Procurement of Power from Grid-Connected Solar PV Power Projects on 03.08.2017. On 10.01.2019, Solar Energy Corporation of India Limited (SECI) issued the Request for Selection (RfS) for setting up 1200 MW ISTS-connected Solar Power Projects in India under Tariff-Based Competitive Bidding. SBSR participated in the bid process and submitted its bid on 15.02.2019. The e-reverse auction was held on 25.02.2019, and SBSR was declared as the successful bidder for the supply of 300 MW @ Rs. 2.61/kWh. On 05.03.2019, SECI issued a Letter of Award (LoA) in favour of SBSR for the development and establishment of the 300 MW Solar Power Project in the State of Rajasthan.

b) On 17.06.2019, SECI executed the Power Sale Agreement (PSA) with BSES Yamuna Power Limited (BYPL) for the supply of 150 MW, wherein 100 MW was to be procured from SBSR. On 26.06.2019, SECI executed another PS
