Petition under Section 79 of the Electricity Act 2003 read with Regulations 11A, 41 and 42 of the Central Electricity Regulatory Commission (General Network Access) Regulations 2022 (as amended from time to time), inter alia seeking for quashing/ setting aside of the letter dated 03.09.2025 issued by the Central Transmission Utility of India Limited thereby revoking the 175 MW connectivity granted to the Petitioner under Regulation 11B (1) of the CERC (General Network Access) (First Amendment) Regulations 2023.

ORDER

The Petitioner, Airpower Windfarms Pvt. Ltd (AWPL), has filed an instant Petition seeking direction to quash/ set aside the letter dated 03.09.2025 issued by the Central Transmission Utility of India Limited (CTUIL), whereby the 175 MW connectivity granted to the Petitioner has been revoked under Regulation 11B (1) of the Central Electricity Regulatory Commission (General Network Access) Regulations 2022 amended from time to time (in short, the ‘2022 GNA Regulations’).

2. The Petitioner has made the following prayers in the present Petition:

(a) Quash/ set aside the letter dated 03.09.2025 issued by the Central Transmission Utility of India Limited to the Petitioner and direct the said Respondent to reinstate/ restore the connectivity of

175 MW of the Petitioner, in terms as stated in the present Petition;

(b) Direct the Respondent, Central Transmission Utility of India Limited to refund the amount of INR

4.00 Crores submitted by the Petitioner on 04.09.2025; and (c) Pass such other or further order(s) as this hon’ble commission may deem fit in the facts circumstances of the present case.

3. The Petitioner has also filed IA No.85/2025, with the following prayer(s):

(a) Direct CTUIL to stay the revocation of the connectivity granted to the Applicant/ Petitioner and to not allocate or release the capacity of said connectivity to any other applicant(s);

(b) Direct CTUIL to not encash the Bank Guarantees bearing BG Nos. 15300100017196 amounting to INR 50,00,000/- (INR Fifty Lakhs Only), BG No. 15300100017197 amounting to Rs. 3,50,00,000.00/- (INR Three Crores and Fifty Lakhs Only) and BG No. 15300100016715 amounting to INR 17,50,00,000/- (INR Seventeen Crores Fifty Lakhs Only), furnished by the Applicant / Petitioner to the Respondent;

(c) Direct CTUIL to not take any coercive action in the context of revocation of the connectivity and/or encashment of the BGs in any manner whatsoever, till the pendency of the present Petition;

(d) Permit the Petitioner to carry out all commissioning activities including, but not limited to First Time Charging and Trial Run Operation in respect of their Project; and (e) Pass such other or further order(s) as this Hon'ble Commission may deem fit in the facts and circumstances of the present case.

4. Petitioner vide IA No. 86/2025 has made the following prayer(s):

(a) Allow the urgent listing of the accompanying Petition and Application seeking Interim Relief filed by the Applicant; and (b) Pass such other or further order(s) as this Hon'ble Commission may deem fit in the facts and circumstances of the present case.
