ORDER

The Petitioner, VEH Jayin Renewables Private Limited (hereinafter referred to as “the Petitioner”), has filed the present Petition inter alia seeking relaxation and condonation of delay in furnishing Connectivity Bank Guarantees, namely Conn-BG1 and Conn-BG3, in terms of Regulation 37(10)(d)(ii) of the Central Electricity Regulatory Commission (Connectivity and General Network Access to the inter-State Transmission System) (Third Amendment) Regulations, 2025.

2.The Petitioner has made the following prayers vide the instant Petition:

a) Admit the present Petition;

b) Exercise its powers under Regulations 41 and 42 of the CERC (Connectivity and General Network Access to the inter-State Transmission System) Regulations, 2022, to relax and condone the delay in furnishing Conn-BG1 and Conn-BG3 in respect of the additional 45 MW generation capacity, in the interest of justice, equity, and regulatory consistency;

c) Direct CTUIL to accept the Conn-BG1 and Conn-BG3 furnished by the Petitioner as valid compliance under Regulation 37(10)(d)(ii) and consequently protect and continue the approval granted for the additional 45 MW solar capacity forming part of the Petitioner’s Hybrid Project;

d) In the alternative, pass appropriate directions under Regulation 42, removing any difficulty arising from the implementation of Regulation 37(10)(d)(ii) in the peculiar facts of the present case;

e) Pass such further order(s) and direction(s) as this Hon’ble Commission may deem fit and proper in the facts and circumstances of the present case.

3. In addition, Petitioner has also made a prayer for interim relief vide instant Petition as below:

a) Restrain the Respondent, Central Transmission Utility of India Limited (“CTUIL”), from taking any action prejudicial to the rights and interests of the Applicant, including but not limited to revoking the approval granted for the additional 45 MW Solar capacity forming part of the Applicant’s Hybrid Project under Regulation 37(10)(d)(ii) of the CERC GNA Regulations, or taking any consequential, coercive, or precipitative steps in relation thereto;

b) Permit the Applicant to continue all commissioning and associated activities in respect of the 151.8 MW Wind Power Project and the additional 45 MW Solar Power Project, without prejudice to the rights and contentions of the parties;

c) Direct CTUIL to process the technical data already submitted by the Applicant and issue connection details in FORMAT-CONN-TD-4 for both the 151.8 MW Wind Project and the additional 45 MW Solar Project;

d) Direct CTUIL to process
