The Petitioner, POWERGRID Khavda II C Transmission Limited (erstwhile “POWERGRID KPS3 Transmission Limited”) (hereinafter referred to as “PKIICTL”), has filed the present Petition under Section 14 of the Electricity Act, 2003 (hereinafter referred to as “the Act”) read with the provisions of the Central Electricity Regulatory Commission (Procedure, Terms and Conditions for Grant of Transmission License and other related matters) Regulations, 2024 (hereinafter referred to as “the Transmission Licence Regulations”) for amendment of the existing RTM Transmission Licence to PKIICTL to include the transmission project “Transmission System for providing connectivity to M/s Sarjan Realties Pvt Ltd. (1100 MW) at KPS3 (400kV Sec- I)” under the Regulated Tariff Mechanism (hereinafter referred to as “RTM”) mode (hereinafter referred to as the “transmission project”). The scope of the project for which a transmission licence has been sought is as under:

The Petitioner, an Inter-State Transmission Licensee, inter alia implemented the transmission project of the “Khavda Pooling Station-3 (KPS3) in Khavda RE Park” through Tariff Based Competitive Bidding route (hereinafter referred to as “TBCB Project”). The Commission, vide order dated 31.8.2023 in Petition No. 145/TL/2023, has granted a transmission licence (hereinafter referred to as “TBCB Licence”) to the Petitioner for the aforesaid TBCB Project.
Subsequently, the Petitioner was inter-alia assigned additional transmission project under Regulated Tariff Mechanism (hereinafter referred to as “RTM’) and the Commission, vide order dated 3.5.2024 in Petition No. 58/TL/2024 granted a separate RTM transmission licence (hereinafter referred to as “RTM Licence”) to the Petitioner for the implementation of the transmission system for evacuation of power from potential renewable energy zone in Khavda area of Gujarat under Phase-IV (7 GW): Part E3 to the Petitioner.
Subsequently, CTUIL, vide OM dated 4.11.2025, has approved the Implementation of the transmission projects viz. “Transmission System for providing connectivity to M/s Sarjan Realties Pvt Ltd. (1100 MW) at KPS3 (400 kV Sec-I)” along with identifying the implementing agency and also addressing the same to the Ministry of Power, Government of India, and NCT.
The Petitioner has submitted that upon amendment of the existing RTM transmission licence, the Petitioner shall implement the aforementioned scheme under the RTM mode. The estimated completion cost of the transmission scheme, as per CTUIL’s Office Memorandum (OMs) dated 4.11.2025, is Rs. 51 crore. After completion of the transmission scheme, the Petitioner shall approach the Commission for the determination of the transmission charges in accordance with the Tariff Regulations.
The Commission, after considering the application of the Petitioner in light of the provisions of the Act and the Transmission Licence Regulations, vide its order dated 26.7.2026, prima facie proposed to grant a separate transmission licence to the Petitioner to implement the transmission projects detailed in paragraph 1 of the order. The relevant extract of the order dated 26.7.2026 is extracted as under:
“24. Since the Petitioner is already an inter-State transmission licensee and has already been granted an RTM transmission licence to implement the transmission projects under RTM mode and again has been identified as an agency to implement the project under the RTM, we hold that the Petitioner is eligible for the amendment of the existing RTM transmission licence. We hereby direct that a public notice under clause (a) of sub-section (5) of Section 15 of the Act be published to invite suggestions or objections to the amendment of the existing RTM transmission licence aforesaid. The objections or suggestions, if any, shall be filed by any person before the Commission by 3.8.2026.”
