Advocates:
For the Appellants/Petitioners: Ms. Radhika Chandrasekar
For the Respondents: Shri N. Satyanarayana

SCNs for reverse charge on imported services invalid without referencing specific Place of Provision Rules limb and per-service bifurcation; TDS not includible in taxable value; cenvat credit on storage rent eligible; extended limitation inapplicable post-audit.

Headnote:(A) Finance Act, 1994 - Sections 66A, 67, 73(1), 76, 78, 80; Service Tax Rules, 2006 - Rule 2(1)(d)(iv); Taxation of Services (Provided from Outside India and Received in India) Rules, 2006 - Rule 3; Service Tax (Determination of Value) Rules, 2006 - Rule 7; Cenvat Credit Rules, 2004 - Rule 15 - Reverse charge mechanism on imported services - Show cause notices held invalid for not specifying applicable limb of Rule 3 of Place of Provision Rules (imported services rules), failing to bifurcate consideration per service category, and relying solely on profit & loss accounts without invoice details - Service tax not payable on TDS amounts separately deducted and paid, as tax due on gross consideration per agreements - Cenvat credit on renting of immovable property for storage upheld, no requirement for premises registration or one-to-one nexus - Extended period of limitation not invocable post-audit knowledge or subsequent notices, absent evidence of suppression/fraud. (Paras 17-28)

(B) Show Cause Notice - Validity - Must detail statutory provisions including specific rules for taxability, quantify demands per service with evidence like invoices, not vague totals from financial statements - SCN foundation for proceedings; vagueness vitiates demand. (Paras 19-21)

(C) Limitation - Extended period under Section 73(1) proviso inapplicable where audit conducted, records examined, no suppression proved; cannot be re-invoked in subsequent notices after initial SCN. (Paras 25-28)

Facts of the case:
Appellant, provider of catering, mandap, health, cleaning, internet, and property renting services, received architect, maintenance, repair, air travel, technical inspection, and business auxiliary services from abroad. Audit detected alleged short-payment under reverse charge by excluding TDS from taxable value, non-payment on other imported services, and wrongful cenvat credit on unregistered rented premises used for storage. Multiple SCNs/SODs issued over 2007-2017 invoking extended limitation, confirmed by lower authorities with penalties.

Findings of Court:
All demands set aside: SCNs defective for omitting Place of Provision Rules reference and service bifurcation; TDS not includible in taxable value; cenvat credit eligible for business storage use; extended limitation invalid post-audit.

Issues: (1) Validity of short-payment demand on architect services excluding TDS; (2) Tenability of lumped demands on various imported services sans bifurcation; (3) Propriety of denying cenvat credit on unregistered storage premises; (4) Invocability of extended limitation.

Ratio Decidendi: Taxability of imported services requires notice of specific Place of Provision Rules limb; demands must quantify per service with evidence, not P&L extracts; TDS over invoice not consideration for service tax; credit allowable for output service nexus without premises registration; limitation barred post-audit awareness, no mala fides proved.

Result: Appeals allowed; impugned orders set aside with consequential reliefs.

These appeals being interconnected and having similar issues, are therefore heard together and are disposed of by this common order.

2. The relevant facts are that the appellant is a registered service provider of outdoor catering service, mandap keeper service, health club fitness service, dry cleaning service, internet services and renting of immovable property services. During Audit by the officers of CERA, Chennai, it was found that the appellant was receiving architect services from foreign service providers. It was noticed that towards the architectural fees paid to the service providers during the period 2008-2009 to 2009-2010, the appellant while paying service tax under Reverse Charge Mechanism, had excluded the TDS payments from the taxable value. The Department was of the view that thus there was a short payment of service tax. Therefore, a Show Cause Notice (SCN) dated 27-05-2011, was issued demanding service tax along with applicable interest and proposing penalties under Section 76 & 78 of the Finance Act, 1994 (Act). The Notice was issued invoking the extended period of limitation under proviso to Section 73(1) alleging that but for the detailed verification of accounts undertaken by the CERA Officers, Chennai, the facts of short payment would not have come to the notice of the Department. After due process of law, the Adjudicating Authority, vide Order-in-Original (OIO) No. 171/2012, dated 31-08-2012 confirmed the demand and imposed an equivalent penalty under Section 78 of the Act. Aggrieved, the appellant preferred an appeal before the Commissioner of Service Tax, (Appeals-II), Chennai. However, the Appellate Authority, vide Order-in-Appeal (OIA) No. 198/2015 (STA-II), dated 10-08-2015, rejected the Appeal and upheld the said OIO. The appellant challenged the said OIA of the Appellate Authority in Appeal No. ST/42288/2015 before this Tribunal.

3. The appellant was thereafter issued a SCN No.309/2012, dated 15-10-2012, alleging that on verification of the appellant's ledger accounts, profit and loss accounts and other private records, it was noticed that the appellant had received maintenance and repair service, air travel agent service, technical inspection and certification service, architect services and business auxiliary service from various service providers situated abroad for which the appellant had made payments in foreign currencies to the said foreign companies. Though the appellant had reflected the service tax paid in respect of architect service and business auxiliary service that has been received from abroad in their ST3 returns, however, they had not included the TDS portion in computing the taxable value and in respect of the remaining services, the appellant had not paid any service tax including the TDS paid by the appellant on such expenditure. It was also noticed that the appellant had wrongly availed cenvat credit of service tax paid under renting of immovable property in respect of a premise not registered under the appellant’s registration certificate and from which the appellant was not providing any output service. The department was also of the opinion that, but for the visit of the audit group, the above said non-payment/
