1. By this petition, the following reliefs have been sought for:-

“1. Issue an appropriate writ/order/direction to the respondent authorities thereby set aside the Order dated September 2, 2024 (Annexure P/1) and

2. the Show Cause Notice dated July 1, 2024 (Annexure P/2) may kindly be set aside, and/or

3. Any other relief as deemed fit by this Hon'ble Court.”

2. Challenge in this writ petition is to the order dated 02.09.2024 passed by Collector, Raigarh (C.G.) in case No. 01/2024 by which the Tanker bearing registration No. GJ12-BX-9751 transporting 34KL of High Speed Diesel was seized on 12.06.2024 by the Food Officer, Dharamjaigarh and subsequently on 02.09.2024 subjected to confiscation by the Collector, Raigarh under Section 3/7 of the Essential Commodities Act . The petitioner at the same time is also challenging the Show Cause Notice dated July 1, 2024 issued by respondent No.2 which is marked as Annexure P- 2 to show cause as to why the appropriate legal proceedings be not initiated against it.
