1. This appeal is directed against the judgment of conviction and order of sentence dated 30.03.2019 passed by Learned Additional Special Judge (Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, in Special Case No. 29 of 2018 by which the appellant has been convicted under Section 304 Part II of the IPC and sentenced to undergo RI for 5 years and to pay fine of Rs. 500/- in default of payment of fine to further RI for one month under Section 304 Part II of the IPC.

2. Case of the prosecution in brief is that on 19.04.2018 complainant Devnath Singh lodged the report alleging that on 18.04.2018 at about 10.00 PM in the night he was in the shop at that time Kartik Ram Aarmo along with Santosh Sahu and Kamalnarayan reached the shop of Devenath where scufÒe took placed between the appellant and the deceased.
