1. This is the Second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 165/2024 registered at Police Station Chhal, District- Raigarh (C.G.) for the offence punishable under Sections 305(E), 331(4), 316(3), 316(4), 336(3), 338, 340(2), 3(5) of Bhartiya Nyaya Sanhita and Section 3(2) of Prevention of Damages to Public Property Act

1984.

2. The earlier bail application of the applicant was dismissed as withdrawn, passed by this Court being MCRC No. 6714/2024, vide order dated 20.11.2024. Hence this Second bail application.

3. Case of the prosecution, in brief, is that on 01.09.2024, the Security In-Charge of BNS SECL, Sub-Area Chhal namely Nanki Babu Sidar has lodged an F.I.R. before the concerned Police Station, stating therein that in Chhal Open Cast Mines on 31.08.2024 at night shift, two unauthorized trucks bearing vehicle No, CG-11-BJ- 7600 and CG-11-BJ-7597 entered in the mines premises without proper RFID card and after having loaded the coal in the truck, while on their way to exit through the boom barrier, on checking of pr
