1. Heard Mr. Navin Shukla, learned counsel for the petitioners.

Also heard Mr. Nitansh Jaiswal, learned Panel Lawyer for respondent No.1/State as well as Mr. C.R. Sahu, learned counsel for respondent No.2.

2. Learned counsel for the petitioners submits that petitioner No.2- Mr. Chandrabhan Singh has died.

3. In view of the above, petition filed on behalf of petitioner No.2 is dismissed as infructuous.

4. By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 the petitioners have prayed for following relief:-

“It is, therefore, prayed that this Hon'ble Court in exercise of its inherent powers under Section 482 of Cr.P.C. may kindly be pleased to allow this petition, quash the entire criminal proceeding initiated under the crime no. 410/2019 registered at Police Station Civil Lines Raipur and the charge sheet bearing no. 432/2019 and also against the charges framed against the petitioners dated 05.01.2022 in Criminal Case No. 11539/2019 by the learned Chief Judicial Magistrate Raipur, whereby the charges U/s 498(A) r/w Section 34 of IPC has been framed against the petitioners, in the interest of justice.”
