1. Proceedings of this matter have been taken through video conferencing.

2. The applicant has preferred this anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 59/2025, registered at Police Station –

Tarbahar, District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 316(5), 318(4), 61(2) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution story complainant namely Amit Kumar Chandrawanshi filed a written complaint. That Manager one Kishan Tiwari, Pradip Das Manikpuri, present applicant Deepak Miri, Nimesh Rajak, and Akash Rajak while working in the Amazon Retail Office, Vyapar Vihar Bilaspur committed the offence of embezzlement worth Rs 6,68,125/- of the articles of the consumers. Thereafter the complainant registered the complaint before the concerning police station and the police station registered the offence under section 316(5),318(4),61(2)

of B.N.S.S.

4. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits the applicant was working as the delivery agent of the Shura Amazon Retail Outlet situated at Vyapar Vihar, Bilaspur and was working under the guidance and direction of the Manager Kishan Tiwari and the present applicant has no connection with the crime. He further submits that applicant has no criminal antecedents, Therefore, he prays for grant of anticipatory bail to the applicant.

5. On the other hand, the learned State counsel opposes the submission made by the learned counsel for the applicant and submits that the present applicant along with other co-accused persons committed fraud, therefore, he is not entitled for grant of anticipatory bail in the present case.

6. I have heard learned counsel for the parties and perused the case diary.

7. Considering the nature and gravity of the offence and material on record and from perusal of the case diary, it appears that the present applicant along with other co-accused persons committed offence of embezzlement worth Rs.6,68,125/-, therefore, I am not inclined to grant anticipatory bail to the applicant.

8. Accordingly, the anticipatory bail application of the applicant –

Deepak Miri, involved in Crime No. 59/2025, registered at Police Station – Tarbahar, District – Bilaspur (C.G.) for the alleged commission of offence punishable under Sections 316(5), 318(4), 61(2) of the Bhartiya Nyaya Sanhita, 2023, is rejected
