1. Grievance raised of the petitioners in the instant writ petition is that the petitioners though stood retired as government servants, but respondent authorities have not given benefit of leave encashment to them.

2. Learned counsel for the petitioners submits that identical issue came up before this Court for consideration in a batch of writ petitions, leading of which being WPS No. 3870/2021 (Faguvaram Patel and Others Vs. State of Chhattisgarh and others). The said writ petitions have been allowed by this Court vide order dated 30.09.2022 directing the respondents to grant leave encashment and surrender leave to petitioners within specified time, therefore, it is prayed by the counsel that similar relief may also be granted to the present petitioners.

3. Learned counsel appearing for the State also admitted the fact that the claim of the petitioners can also be considered in the light of order passed in the matter of “Faguvaram Patel” (supra) in accordance with law.

4. Considering the aforesaid submissions made by learned counsel for petitioners as well as the State based on decision taken in the matter of “Faguvaram Patel” (supra), this petition is disposed of directing the respondents authorities to consider the claim of petitioners for grant of leave encashment in the light of order passed in the matter of “Faguvaram Patel” (supra) within a period of 03 months from the date of production of copy
