1. As these appeals have been preferred by the Owner of the vehicle which was involved in the same accident, they are being heard and disposed of by this common order.

2. Both appeals are the owner’s appeal against the award dated 08.12.2015 passed by the Additional Motor Accident Claims Tribunal, Ramanujganj, District –

Balrampur-Ramanjuganj (C.G.) in Motor Accident Claim Cases No. 13/2014 & 12/2014.

In MAC No. 109/2016

3. As against compensation of Rs.25,75,000/- claimed by the respondents No.3 to 7/claimants by filing claim application under Section 166 of the Motor Vehicles Act (henceforth ‘the Act’) for death of Baby Devi in the motor accident on 01.06.2014, the Tribunal awarded a total sum of Rs.7,35,500/- along with interest at the rate of 9% per annum in favour of the claimants.

As against compensation of Rs.11,25,000/- claimed by the respondent No.3/claimant by filing claim application under Section 166 of the Motor Vehicles Act (henceforth ‘the Act’) for death of Meera Devi in the motor accident on 01.06.2014, the Tribunal awarded a total sum of Rs.2,57,700/- along with interest at the rate of 9% per annum in favour of the claimant.

5. The Tribunal, on due consideration of the evidence, held that the accident had occurred due to rash and negligent driving of tractor chichis No. RFNB
