IN THE HIGH COURT OF CHHATTISGARH AT BILASPUR
Ramesh Sinha, CJ, Amitendra Kishore Prasad, J
SIYARAM PATEL – Appellant
Versus
STATE OF CHHATTISGARH – Respondent
CRMP/2458/2019

Advocates:
Mr. Samarth Singh Marhas, Advocate; Mr. Sakib Ahmed, Panel Lawyer

The court ruled that a charge-sheet based on a private complaint for forgery and cheating cannot be initiated without prior sanction under Section 195 of the CrPC, emphasizing the need for a prima facie case of deliberate falsehood.

Headnote:(A) Code of Criminal Procedure, 1973 - Section 482 - Indian Penal Code, 1860 - Sections 120B, 420, 467, 468, 471 - Quashing of charge-sheet - Petitioners sought to quash the charge-sheet filed against them for alleged forgery and cheating related to a death certificate - The court found that the allegations were general and lacked specificity, and that the Chief Judicial Magistrate erred in taking cognizance based on a private complaint without proper sanction as required under Section 195 of CrPC - The court emphasized that the prosecution for perjury should only be initiated when there is a prima facie case of deliberate falsehood - The court quashed the charge-sheet and all subsequent proceedings against the petitioners.
