A serious allegation of fraud under Section 420 IPC justifies the refusal of anticipatory bail.

1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.94/2025 registered at Police Station- Nagarnar, District - Bastar (C.G.) for the offence punishable under Section 420 of I.P.C.

2. Prosecution case in brief is that, on 13.04.2025, the complainant lodged a written complaint against the applicant in the Nagarnar Digitally signed by BHUMIKA BHUMIKA ANGARE ANGARE Date:

2025.05.21 +0530 Police Station to the effect that the complainant's husband is acquainted with the applicant, he said that the applicant is acquainted with high officials in the health department, he asked for a nurse's job in Dimrapal Superspecialist Hospital, then the applicant said that it would cost 1 lakh rupees, then the complainant's husband transferred Rs 20,000/- and Rs 30,000/- online on 04.06.2024 and 05.06.2024 from Phone-Pay number 7683972084 to the applicant's number 9404214670 and on 17.06.2024 Rs. 50,000/- were given in cash. Thus, even after giving a total of 1,00,000/- rupees to the applicant, the complainant did not get the job. Thereafter Police Station Nagarnar has registered the case for an punishable offence under Section 420 of I.P.C. Subsequently the F.I.R. is registered, hence, this anticipatory bail application before the Hon'ble Court.

3. Learned counsel appearing for the applicant submits that the applicant is innocent person and he has been falsely implicated in the abovementioned offence. She further submits that the applicant has helped another woman to borrow money and on a dispute with regard to the said loan he has returned Rs. 20,000/- from his own pocket to the complainant on a settlement arrived at before Nagarnar Police Station and also given an undertaking to pay the remaining amount in installments, however to falsely implicate and to extort money the complainant has lodged the FIR, therefore, the present applicant is entitled to be granted anticipatory bail.

4. On the other hand, learned State counsel appearing for the Non-

applicant/State opposes the prayer for grant of anticipatory bail and submits that the applicant has collected huge amount on the false promise of providing job to the complainant, therefore, the anticipatory bail application of the present applicant is entitled to be rejected.

5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, the applicant is said to have with an intention to cheat the complainant has collected huge amount as such the allegation raised against him is serious in nature, therefore, I am not inclined to grant anticipatory bail to the applicant.

7. Accordingly, the bail application of the applicant – Manoj Kumar Thakur, involved in Crime No.94/2025 registered at Police Station- Nagarnar, District - Bastar (C.G.) for the offence punishable under Section 420 of I.P.C, is rejected.
