1. At the very outset, learned counsel for the petitioner submits that he is not pressing the relief as prayed for in para 10.1, however, his grievance is with respect to the relief as prayed in para 10.2.
2. Learned counsel for the petitioner submits that the petitioner is owner of the land bearing khasra No. 245/10 situated at village Kusmi, PH No.6, Revenue Inspector Circle-Kusmi, Tahsil-Samri, District-Balrampur-Ramanujganj. Initially, The petitioner was allotted a shop in 2008 constructed by the respondent No. 5, in which, the petitioner was doing the business of sale of auto- parts. Subsequently, the respondent No. 5 has issued a notice for vacating the said shop, upon which, the petitioner has agreed to vacate the shop and the shop was also vacated. After vacating the shop by the petitioner, the respondent No. 5 has started the proceedings for construction of the shopping complex on the said land including the private ownership land of the petitioner.
