1. Heard Mr.Amarnath Pandey, learned counsel for the petitioner as well as Mr.Hariom Rai, learned Panel Lawyer appearing for respondent No.1/State.
2. The present petition has been filed by the petitioner under Section
482 of the CrPC with the following prayer :-
“(1) quasd the FIR dated 17.12.2021 in Crime No.470/2021 registered at Police Station Saraipali and consequent chargesheet number 93/2023 under section 363, 366, 376(2)(n) of IPC & Section
4, 6 of POCSO Act.
(2) Quash entire criminal proceeding in Special Criminal Case No.05/2023 pending before the Special Judge (POCSO) Saraipali, Distt.
Mahasamund (C.G.)
(3) pass any other order in view of the special facts and circumstances mentioned in the present petition, in the interest of justice.”
3. Learned counsel for the petitioner submits that the prosecution evidence has been closed and the case is fixed for recording the statement of the petitioner before the trial Court.
