1 Heard Mr. Ashish Shrivastava, learned Senior Advocate assisted by Mr. Rahul Ambast, learned counsel for the petitioner as well as Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State/respondent.
2 The present petition has been filed by the petitioner under Section
528 of the Bhartiya Nagrik Suraksha Sanhita , 2023 with the following prayers :-
“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to quash and set-aside the impugned FIR registered vide dated 04.07.2024 (Annexure P/1) in crime no. 0403/2024 for the alleged offences under Section(s) 409, 420, 467, 468, 471 & 120-B of the Indian Penal Code , 1860 against the petitioner, in the interest of justice.”
3 The Director General of Police, Raipur (Chhattisgarh) has filed an affidavit, whereby it has been stated that as the two co-accused are still absconding, hence, the investigation could not be concluded.
4 It has been submitted by learned Senior Advocate for the petitioner that the said two co-accused have already been granted anticipatory bail and the petitioner himself has been granted regular bail long back in the month of August 2024 itself,
