1. Post of Kotwar of village Nawagaon, Gajri Patwari Halka No. 19, Revenue Nigam Mandal, Kunda, Tahsil Pandariya, District Kawardha fell vacant. Appointing Authority i. e. Naib Tahsildar, Kunda initiated proceeding for appointment on the said post in accordance with the Kotwari Rules framed under the Code and after complying the formalities, by order dated 30/12/2000, the petitioner was appointed on the post of Kotwar of said village.

2. The order appointing Kotwar to the petitioner was challenged by respondent No. 6 herein - Latel before the Sub-Divisional Officer (Revenue), Pandariya. The Sub-Divisional Officer set aside the order passed by Tahsildar by order dated 31/03/2001 finding violation of the Kotwari Rules and matter was remanded back to the Naib Tahsildar for making
