1. With the consent of the parties, heard the matter finally along with I.A. No. 1/2016 under S.320 (6) of the Code of Criminal Procedure, 1973 (in short 'the Code' ) for permission to compound the offence along with the fact that the applicant and complainant PW - 1 Smt. Umabai recorded their statement before the Additional Registrar (Judicial) as per order dated 16-02-2016.

Facts in brief required for adjudication of the instant criminal revision are that the Judicial Magistrate First Class Mahasamund in Criminal Case No. 319/2001 vide judgment dated 18-3-2004 convicted the present applicant along with other co - accused Mehattar for the offence under S.498A of the Indian Penal Code, 1860 (in short 'the IPC ' ) and sentenced rigorous imprisonment for one year and to pay fine of Rs. 1000/-, in default of payment of fine, to further undergo additional rigorous imprisonment for two mont
