1. This appeal by the convicted Accused / Appellant is directed against the judgment dated 07.05.2010 delivered by the learned Sessions Judge, Mahasamund, in Sessions Trial No. 65 of 2009 whereby he convicted the Accused / Appellant for having committed an offence punishable under S.376(1) of the Indian Penal Code and sentenced him to undergo rigorous imprisonment for 10 years and to pay fine of Rs. 5000/-. In default of payment of fine, the Appellant was required to undergo further simple imprisonment for six months.
2. The prosecution story, briefly stated is that on 23.07.2009 at about 10:00 am, the prosecutrix was sitting outside her house alone. It has been stated that on the date of alleged occurrence, the prosecutrix was aged 16 years.
