1. Heard Mr. Vinay Nagdev, learned counsel appeared for the petitioners through VC, Mr. Nitansh Jaiswal, learned Dy. G.A. for the State/re- spondent No. 1 as well as Mr. Anmol Sharma, learned counsel for the respondent No. 2.

2. By this petition under Section 528 of the BNSS, the petitioners have prayed for the following relief(s):

“It is therefore prayed that this Hon’ble Court may kindly be pleased to quash the F.I.R. No. 12/2024 dated 24.02.2024 registered at Mahila Thana, Durg (C.G.) against the petition- ers for the offences punishable under Section 498-A read with Section 34 of Indian Penal Code.”

3. The facts, in brief, as projected by the petitioners are that on

24.02.2024, a complaint was filed by respondent No. 2 before the Mahila Thana, Durg alleging that the marriage between respondent No.2 and Mo. Shadab Qureshi was solemnized on 01.03.2021 who is son of the petitioners thereafter the complainant resided with the peti- tioners for a short span till 01.02.2023, thereafter the complainant and her husband i.e., the petitioners' son left their home to reside sepa- rately. It is imperative to state here that while leaving the house of the petitioners on 01.02.2023, the complainant and her husband took all their belongings with them. After more than a year, the complainant due to vengeance with her husband, lodged a written complaint before the concerned p/s in which she alleged that after her marriage she was subjected to cruelty and harassment for demand of dowry.

4. Learned counsel for the petitioners submits that the complainant along with her husband, left the home of the petitioners at her own will to re- side separate. After leaving, neither the complainant nor her husband ever came back to reside with the petitioners and they broke all their ties with the petitioners. After more than a year, the complainant due to vengeance with her husband, lodged a written complaint before the concerned p/s in which she alleged that after her marriage she was subjected to cruelty and harassment for demand of dowry. The allega- tions levelled by the complainant was not supported by cogent and reli- able documents and vague and bald allegations were levelled against the petitioners. The complainant has also deliberately concealed the fact that on 01.02.2023 she left her matrimonial home with her hus-

band at her own will and thereafter never returned back.

It has further been argued by learned counsel for the petitioners that there was a matrimonial dispute between son of the petitioners and re- spondent No. 2 as they are husband and wife and their marriage was solemnized on 01.03.2021 hence, the present proceedings against the petitioners who are inlaws of respondent No.2 be quashed. He lastly submits that in compliance to the Court’s order dated 02.07.2025, the petitioner No. 1 has already deposited a sum of Rs. 50,000/- in the High Court Mediation Centre which has further been deposited to the respondent No. 2
