1. Heard Ms. Ravipal Maheshwari, learned counsel appearing for the petitioner. Also heard Mr. Shaleen Singh Baghel, learned Govt.

Advocate, appearing for the Respondents-State.

2. The present petition under Section 528 of BNSS, 2023 has been filed by the petitioner with the following prayer:-

“1. That, Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioner, in the interest of justice.

2. That, Hon'ble Court may kindly be pleased to quash the impugned FIR bearing No. 31/2024 registered on dated 06.08.2024 at police station EOW/A.C.B. Raipur, District Raipur Chhattisgarh filed under section 7, 12 of P.C. Act and final report filed on dated 01.10.2024 in respect of the case of the petitioner, in the interest of justice.

3. That, Hon'ble Court may kindly be pleased to quash entire charge sheet dated 01.10.2024 before learned Special Judge (P.C. Act) cum First Upper Sessions Judge Raipur District Raipur Chhattisgarh Chhattisgarh under section 7, 12 of P.C. Act and cognizance dated 01.10.2024 against the petitioner in the interest of justice.

4. That, Hon'ble Court may kindly be pleased to quash impugned proceeding against the petitioner (Annexure P-1) in Special Criminal Case No.06/2024 against the petitioner, in the interest of justice.

5. That, the Hon’ble Court may kindly grant any other reliefs in favour of the petitioner, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case, in the interest of justice.”

The case of the prosecution is that, complainant Lukesh Kumar Baghel has made a complaint to Anti Corruption Bureau, Raipur (in short ‘A.C.B.’) with the allegation that when he contacted Secretary of the Gram Panchayat for NOC for construction of his house and for the process of bank loan over his land of Khasra No.15005/18 area 1250 square feet of village Doma, the Secretary of Gram Panchayat Doma asked him to pay Rs.22,000/- as bribe. The conversation between the complainant and the Secretary of Gram Panchayat, namely, Dharmendra Sahu was recorded on 22-07-2024 and after its verification by the A.C.B., the Dehati Nalisi was registered was registered and trap team was constituted. On 05-08-2024 the trap party after preparing various panchnamas and other formalities gone to the office of the Secretary of the Gram Panchayat. After completion of the transaction when the complainant made gesture the trap party conducted raid in the office of the Secretary of Gram Panchayat. The complainant disclosed that on the instance of Secretary of Gram Pnachayat Dharmendra Sahu he gave the tainted currency notes to the present petitioner Dev Singh Baghel who is the Sarpanch of the Gram Panchayat.
