1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.516/2025 registered at Police Station Masturi, District-Bilaspur (C.G.) for the offence punishable under Sections 137(2), 140(1), 109 of Bhartiya Nyay Sanhita, 2023.

Case of the prosecution, in brief, is that on 17.08.2025, the complainant Ravishankar Bargah lodged report, alleging therein that one unknown person has taken his niece Suryansh in motorcycle and inflicted injuries over his neck and back side by knife. On the basis of said report, the FIR was registered against unknown person and during course of investigation, the present applicant has been arrested on 19.08.2025.

Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in the instant case and the applicant has not inflicted any grievous hurt upon the injured Suryansh Bargah with intention to kill him, no such grievous hurt has been received upon injured Suryansh Bargah which may cause his death in ordinary course. She would submit that the medical report has not supported the case of prosecution and the injuries of injured have been cured within few days, as he has received simple wound. She would submit that the applicant is having love affair with the elder sister of the injured Suryansh, due to which, the applicant has falsely been roped in this case. She would submit that charge sheet has been filed, the applicant is in jail since 19/08/2025 and conclusion of trial will take some time, therefore, she prays for grant of bail to the applicant.
4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case before the competent court. She would submit that the applicant is said to have assaulted the injured by knife on his neck and back side who received multiple injuries and the injury was found to be grievous in nature and dangerous to life, therefore he is not entitled to be released on bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, considering the nature and gravity of offence that the applicant is said to have assaulted the injured by knife on his neck and back side who received multiple injuries and the injury was found to be grievous in nature and dangerous to life, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of applicant Amit Kumar Bargah involved in Crime No.516/2025 registered at Police Station Masturi, District-Bilaspur (C.G.) for the offence punishable under Sections 137(2), 140(1), 109 of Bhartiya Nyay Sanhita, 2023, is rejected.
8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
