1. Heard Mr. Ashutosh Pandey, learned counsel for the petitioner.

Also heard Mr. Praveen Das, learned Addl. Advocate General appearing for the State-respondents.

2. The present petition has been filed seeking the following relief(s):-

“A. That this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/direction thereby directing the respondents to produce the entire records before the Hon'ble Court in respect of the prosecution sanction order dated 31/10/2025.

B. That this Hon'ble Court may kindly be pleased to set aside the prosecution sanction order dated 31/10/2025 passed by respondent no 2, being violation of provisions of section 19 of the PC (Amendment) Act, 2018.

C. Any other relief which this Hon'ble Court deems fit and proper may be passed.”

3. As per the return filed by the State, the sanction for prosecution has already been given by the Law Department, though the same was refused by the parent department of the petitioner. Learned counsel for the State submits that in pursuance of the circular dated 21-04-1997 (Annexure R/1) the Law Department can very well pass the order granting sanction for prosecution.

4. Learned counsel for the petitioner submits that in view of the return filed by the State, he does not want to press the present petition further.

5. Accordingly, the present petition is dismissed as not pressed without any further liberty.
