Heard on application for amendment of the writ petition.
The petitioner has filed this amendment application whereby a new clause 10(iv) has been added. By way of the said amendment, the petitioner has prayed for refund of the forfeited security deposit amounting to Rs.75,58,887/-, which was forfeited vide order dated
11.1.2016.
Learned counsel appearing for the petitioner would submit that the fact with regard to forfeiture of the security deposit was specifically pleaded in para 9.8 of the writ petition. He would contend that due to inadvertence the petitioner could not make a specific prayer for refund of
respondents No.1 & 2. The petitioner shall carry out the necessary amendment within a period of seven days. The respondents would be at liberty to file an additional return, if so advised. Sd/- (Rakesh Mohan Pandey) Judge
