1. This writ appeal has been preferred under the provisions of the Chhattisgarh High Court (Appeal to Division Bench) Act, 2006, assailing the final order dated 02.01.2026 passed by the learned Single Judge in WP(S) No. 3912/2024 (Smt. Saraswati Maravi vs. State of Chhattisgarh & Others), whereby the writ petition filed by the present appellant came to be dismissed. By the said writ petition, the appellant had called in question the legality, validity and propriety of the order dated 24.06.2024 passed by the Additional Commissioner, Bilaspur Division, Bilaspur, allowing the revision preferred by respondent No.8 and thereby setting aside the order dated 02.02.2023 passed by the Collector, Korba, under which the appellant had been held entitled for appointment to the post of Anganwadi Worker at Anganwadi Centre Sadakpara, Village Sutarra, District Korba. Aggrieved by the dismissal of her writ petition and continuation of appointment of respondent No.8, the appellant has approached this Court by way of the present intra-court appeal.

The facts of the case as emerges from the pleadings of the appeal are that, the appellant is a permanent resident of Village Sutarra, Tahsil Pondi-Uproda, District Korba, and belongs to the Scheduled Tribe (Gond) category. She possesses the requisite educational qualification of Higher Secondary (12th standard) and was fully eligible to apply for the post of Anganwadi Worker in terms of the guidelines issued by the Women and Child Development Department, State of Chhattisgarh.

Pursuant to an advertisement dated 06.05.2022 issued by the Project Officer, Integrated Child Development Scheme, Pondi-Uproda, applications were invited for appointment to the post of Anganwadi Worker for Anganwadi Centre Sadakpara, Village Sutarra, District Korba, for the period from 10.05.2022 to 24.05.2022. One of the essential eligibility conditions stipulated in the advertisement was that the candidate must be a local resident of the concerned village, for which proof of residence could be established either through inclusion in the voter list of the village or by a domicile/residence certificate issued by the Sarpanch and Secretary of the Gram Panchayat or by a competent authority.
4. The appellant submitted her application within the stipulated time along with the requisite documents, including her caste certificate, educational certificates, voter identity card and a residence certificate dated 13.05.2022 jointly issued by the Sarpanch and Secretary of Gram Panchayat Sutarr
