1. This Writ Petition has been filed against the order dated

28.02.2023 (Annexure P/1) passed by Chief Medical and Health Officer, District Mungeli, Chhattisgarh by which, contractual service tenure of the petitioner has been terminated. 2. The petitioner has prayed for the following reliefs:-

10.1 That this Hon'ble High Court may kindly direct to call for the entire records of the case for proper adjudication of the present case;

10.2 That this Hon'ble High Court may kindly be please to pass an appropriate writ to direct the Respondent Authorities to quash the letters of termination of service of the Petitioner issued by the Chief Medical & Health Officer, Mungeli i.e. impugned Letter dated 30.11.2022 [ΑΝΝEXURE P/6] & impugned Letter dated 28.02.2023 (ANNEXURE P/1]

not extending the service of the Petitioner.

10.3 That this Hon'ble High Court may kindly be pleased to pass an appropriate writ to direct the Respondent Authorities to quash the Annual Appraisal Report (APAR) of the Financial Year 2021-2022 of the Petitioner on the ground of it being issued based upon wrongful/irregular assessment by the Respondent Authorities.

10.4 That this Hon'ble High Court may kindly be pleased to issue writ of mandamus to direct the Respondent Authorities to kindly reinstate the Petitioner to the post of District Accounts Assistant on contractual basis under the National Rural Health Mission.

10.5 Any other relief, which this Hon'ble Court may deem fit and appropriate, according to facts and circumstances of the case may also be granted.

3. Necessary facts of the case are that the Petitioner (Nagesh Kashyap) was appointed to the post of District Accounts Assistant on contractual basis under the National Rural Health Mission vide Order No./NRHM/HR/2013/1057 dated 28.09.2013 issued by the Respondent No. 3 i.e. Deputy Director, National Rural Health Mission, Raipur, Chhattisgarh approved by the Mission Director, National Health Mission, Chhattisgarh, Nava Raipur (Respondent No. 6). As per the Appointment Order dated 28.09.2013, the Petitioner was posted at the Office of Chief Medical & Health Officer, Mungeli, Chhattisgarh with effect from 08.10.2013. After working on contractual basis for 3 years, the Petitioner, vide Work Order No./NHM/2016-2017/5327 dated 30.11.2016 issued by the Respondent No. 4 i.e. Chief Medical & Health Officer, District- Mungeli, Chhattisgarh, was put in-charge as District Accounts Manager till further orders with immediate effect for the purpose of making immediate arrangements for successful operation of health services and financial works of all National Programs in the District Program Management Unit, District-Mungeli under National Health Mission.
