1. Heard Mr. Vikas Shrivastava, learned counsel for the petitioner as

well as Mr. SS Baghel, learned Government Advocate, appearing for

respondent No.1/State.

2. Petitioner has filed this petition under Section 528 of the BNSS,

2023 with following prayer:

“It is therefore prayed that this Hon'ble Court may kindly be

pleased to allow the present petition and thereby extend the

time granted to deposit the cost of Rs.2,000/- before this

Hon'ble Court, vide order dated 07.01.2026.”

3. Vide order dated 07.01.2026 in CRMP No.16/2026, this Court has

passed the following order/direction:

“5. Accordingly, this petition is dismissed as withdrawn, with

liberty to file petition afresh with appropriate prayer and

pleadings, subject to depositing a sum of Rs.2,000/- as cost

by the petitioner in the Registry of this Court within a period of

one week from today, and the same shall be transmitted to the

Government Specialized Adoption Agency Bemetara (C.G.),

for wasting the precious time of this Court.”

4. Learned counsel for the petitioner submits that vide order dated

07.01.2026, the petitioner was directed to deposit a sum of Rs.2,000/-

before the Registry of this Court within a period of one week, however,

owing to certain unavoidable circumstances, the petitioner could not

deposit the said amount within the stipulated period. The delay in

compliance of order of this Court is neither deliberate nor intentional.

Hence, the petitioner has approached this Court seeking extension of

time for compliance of the order dated 07.01.2026 passed in CRMP No.

16/2026.

5. Learned State Counsel submits that he has no objection to the

limited prayer made on behalf of the petitioner.

6. In view of above submissions, the instant petition is allowed and

the petitioner is granted one week’s further time to comply with the order

dated dated 07.01.2026 passed by this Court in CRMP No.16/2026.

CC as per rules.
