1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.340/2025 registered at Police Station Katghora, District- Korba (C.G.) for the offence punishable under Sections 109(1), 61(2), 3(5) B.N.S. 2023 & Section 25, 27 Arms Act, 1959.

Case of the prosecution, in brief, is that on 24.09.2025 the complainant Afreen Bano reported at Police Station Katghora that she resides in Ward No. 14, Kasaniya, where she and her mother runs a grocery shop at home. At about 9:00 PM, after closing the shop, she and her family heard a loud noise outside. When she and her father opened the gate, they saw a tall, thin man with his face covered, standing near a motorcycle and loading a gun. On being warned by her brother, they rushed inside while closing the door, during which the man fired a shot that struck the gate. She stated that the shot could have caused fatal injury had the door not been closed. On this report, FIR No. 340/2025 was registered against an unknown person under Section 109(1) BNS and Sections 25 and 27 of the Arms Act. During investigation, two cartridges were seized from the spot, and on the memorandum of co-accused Durgesh, a handmade pistol with empty cartridges was recovered. Upon further investigation, allegations of criminal conspiracy and common intention were added against the present applicant, from whom a Hero HF Deluxe motorcycle was seized, leading to his arrest. Subsequently, Sections 109(1), 61(2) and 3(5) of BNS along with Sections 25 and 27 of the Arms Act were invoked.

Learned counsel for the applicant submitted that the name of the applicant has come into light in the memorandum statement of the co-accused Durgesh Pandey who is said to have fired in the air with country made pistol. He would submit that the charge sheet has been filed in this case, the applicant is in jail since 25/09/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant.

4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case before the competent court and the applicant has no criminal antecedents.

5. I have heard learned counsel appearing for the parties and perused the case diary.

Taking into consideration the facts and circumstances of the case, further the fact that name of the applicant has come into light in the memorandum statement of the co-accused Durgesh Pandey who is said to have fired in the air with country made pistol, period of detention of the applicant since 25/09/2025, charge sheet has been filed, applicant has no criminal antecedents and also considering the fact that trial is likely to take some time for its conclusion, therefore this Court is of the view that the applicant is entitled to be released on bail in this case.

Accordingly, the bail application is allowed and it is directed that the Applicant- Ashish Kumar Jangde, involved in Crime No.340/2025 registered at Police Station Katghora, District- Korba (C.G.) for the offence punishable under Sections 109(1), 61(2), 3(5) B.N.S. 2023 & Section 25, 27 Arms Act, 1959, be released on bail on his furnishing a personal bond with two sureties in the like sum to the satisfaction of the C
