1. The petitioner has filed this writ petition seeking following reliefs.
“10.1 That this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to grant the petitioner the benefit of revised pay scale (equivalent to regular Government Teachers) as per circular dated 17.05.2013, by counting her service from the first appointment dated 14.10.2008, granting weightage of one annual increment for every 2 completed years after 8 years i.e. 14.10.2016 and annual increments thereafter, and fix her pay accordingly in the absorbed post of Teacher (L.B.)
10.02 That, this Hon’ble Court may kindly be pleased to direct the respondents to pay the arrears of pay difference, along with 12%
per annum interest from the due date till actual payment.”
2. Learned counsel for petitioner submits that the petitioner was appointed as Shiksha Karmi Grade-III vide order dated 10.10.2008. He thereafter participated in the fresh recruitment proceedings for appointment on the post of Shiksha Karmi Grade-II and pursuant to order dated 30.05.2009, she was appointed as Shiksha Karmi Grade-II (Biology). According to the circular issued by the State Government dated 17.05.2013, Shiksha Karmis who have completed 8 years of service are entitled for the revised pay scale, however, the petitioners were not extended the said benefit. Though, petitioner has submitted his representation, however, till date no decision has been taken on the same. It is contended that petitioner may be permitted to submit a fresh representation and direction be issued to respondent authority to take decision on the representation of the petitioner, at the earliest.
3. Counsel for the State submits that according to the grievance raised by the petitioner it appears that the competent authority for considering the grievance of the petitioner, would be respondent No. 6 and 7 for whom he is not appearing.
4. I have heard learned counsel for the parties and perused the documents enclosed along with writ petition.
5. Taking into consideration the submission of learned counsel for the parties, nature of grievance raised by the petitioner, instead of keeping the petition pending and seeking reply of the respondents, I find it appropriate to dispose this writ petition at this stage permitting the petitioner to submit a comprehensive representation before Respondents No. 6 and 7 and in turn the concerned authorities are directed to consider and decide the representation of petitioner, in accordance with law, expeditiously, preferably within a further period of 3 months from the date of receipt of representation.
6. Accordingly, this writ petition is disposed of with the aforesaid observation and direction.
