Order On Board
11.02.2026
1. The writ petition has been filed by the petitioner seeking direction against the Enquiry Officer to allow the petitioner to be posted at the original place of posting i.e. at Bhatapara.
2. Learned counsel for the petitioner would submit that the suspension of the petitioner was revoked and he was reinstated and posted at Distribution Center at Gopalpur, which is the other place than the place where he was posted at the time of suspension, therefore, respondents may be directed to post the petitioner at the same place i.e.
Bhatapara.
3. Learned counsel for the respondent would oppose the prayer made by learned counsel for the petitioner.
4. I have heard learned counsel for the petitioner and considered their rival submissions made herein above and gone through the records with utmost circumspection.
5. Admittedly, the petitioner’s suspension has been revoked vide order dated 19.07.2019 and he is posted at new place i.e. Distribution Center at Gopalpur, as such, the petitioner’s grievance has already been redressed.
However, it is well settled that a Government servant can be shifted to new place after revocation of order of suspension which in accordance with law.
6. With the aforesaid observation/direction, the instant writ petition stands disposed off.
