1. The present contempt petition is filed against the alleged defiance of order dated 14/03/2019 passed by this Court in WPS No.1824/2019 wherein the respondents No.3 & 4 therein were directed to take a decision within a period of four months on the claim of the petitioner for grant of compassionate appointment on the post of Gram Panchayat Secretary subject to her fulfilling the requisite eligibility criteria.

2. Learned counsel for the petitioner submits that in compliance of the Court order dated 14/03/2019 passed in WPS No.1824/2019, the petitioner submitted a representation before the respondent No.4. Thereafter, the respondent No.4 rejected the representation of the petitioner vide order dated 29/03/2019. Learned counsel further submits that after rejecting the claim of the petitioner on 29/03/2019, the respondent authorities again sent a letter dated 14/02/2020 Annexure-III to the petitioner to submit all relevant documents related to the post of Panchayat Secretary before the office of the concerned authority. Thereafter, the petitioner appeared before the concerned respondent authority and submitted all relevant documents, but no further action has been taken by the respondent authorities. Thereafter, the petitioner again submitted a representation Annexure-IV on 30/05/2025.

Pursuant to the order of this Court dated 29.1.2026, Smt.Premlata Mandavi, C.E.O, Zila Panchayat Bemetara, District Bemetara, C.G./respondent No.4 appeared before this Court along with her counsel and would submit that pursuant to the order of this Court passed in WPS No.1824/2019 the case of the petitioner has been considered and vide order dated 29.3.2019 (Annexure – R/1) rejected her claim, which has duly been communicated to the petitioner.

4. I have heard learned counsel for the parties, perused the pleadings and documents.

5. From bare perusal, it is apparent that vide order dated 14/03/2019 passed in WPS No.1824/2019, there was a direction to the respondents No.3 and 4 to take a decision within a period of four months on the grievance of the petitioner for the grant of compassionate appointment on the post of Gram Panchayat Secretary subject to her fulfilling the requisite eligibility criteria for the post of Gram Panchayat Secretary. From the reply of the contemnor/respondent, it appears that within a period of four months i.e. 29/03/2019, the C.E.O., Zila Panchayat, Bemetara, C.G. has taken a decision on the claim of the petitioner and rejected the same, which has duly been communicated to the petitioner.

6. As the respondent authority has taken a decision rightly or wrongly vide its order dated 29/03/2019, in my opinion, the respondent authorities have not disobeyed the order dated

14/03/2019 passed by this Court.

7. In view of the above, the contempt petition is dismissed. Rule is discharged.
