1. This is a petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioners namely Jubair Ahmad, Shahid Ahmad and Tammana Khanam, seeking quashment of FIR dated 07.09.2023 registered as Crime No. 363/2023 at Police Station City Kotwali, District Mungeli (C.G.) for the offence punishable under Sections 498-A and 34 of the Indian Penal Code, as well as quashment of the charge-sheet dated 09.03.2024 filed pursuant thereto, the order taking cognizance dated 15.04.2024 passed by the learned Judicial Magistrate First Class, Mungeli in Criminal Case No. 1240/2024, the order framing charge dated 05.11.2024 and all other consequential criminal proceedings arising out of the aforesaid crime. The said FIR has been lodged at the instance of respondent No. 2, who is the wife of petitioner No. 1, alleging cruelty and dowry-related harassment, which, according to the petitioners, are false, vague and motivated, and do not disclose the commission of any cognizable offence, thereby warranting interference by this Court in exercise of its inherent jurisdiction to prevent abuse of process of law and to secure the ends of justice.

2. The petitioners have filed the present Criminal Miscellaneous Petition with the following prayer:-

“It, is therefore, prayed that this Hon'ble Court may kindly be pleased to allow the instant petition and Consequently quash the F.I.R. no. 363/2023 registered with the P.S. City Kotwali, District Mungeli (C.G.) by the Respondent No.1 on 07.09.2023, further quash Chargesheet bearing no. 100/2024 dated 09.03.2024 (ANNEXURE P- 1) and also the order taking cognizance dated 15.04.2024 passed in Criminal Case No. 1240/2024, framing of charge dated 05.11.2024 by the Learned Judicial Magistrate First Class, Mungeli under section 498-A, 34 of IPC against the petitioners (ANNEXURE P-2) and entire proceedings of Criminal Case No. 1240/2024 pending before the Learned Judicial Magistrate First Class, Mungeli (C.G.) against the petitioners pursuant to the aforesaid charge sheet, in the interest of justice.

And/or any other relief relief's which this Hon'ble Court may think fit and proper in the facts and circumstances of the case may please be also granted to the petitioner in the interest of justice.”

3. The facts, in brief, leading to filing of the present petition are that petitioner No.1 and respondent No.2 are husband and wife. Petitioner Nos. 2 and 3 are the brother-in-law (Jeth) and sister-in-law (Jethani) of respondent No.2. The marriage between petitioner No.1 and respondent No.2 was solemnized on 17.12.2022 at Raipur according to Muslim rites and customs.
