1. The present writ petition is being filed seeking following reliefs:-

“10.1 That the Hon'ble Court be pleased to call for the entire records in connection of the petitioner's cases.

10.2 That the Hon'ble court be further pleased to quash the impugned order dated 27.02.2023 (Ann.P/1) passed by the District Education Officer Raigarh rejecting the claim of the petitioner for grant of compassionate appointment.

10.3 That the Hon'ble court be further pleased to direct the Respondent authority to consider and grant of compassionate appointment to the petitioner in the Respondent department as per rules within reasonable period.

10.4 Any other order that the Hon'ble Court deems fit and necessary in the circumstances of the case be also passed.

10.5 That the cost of the petition be also awarded to the petitioners”

Facts of the case, in brief, is that the petitioner, belonging to the Scheduled Tribe community and a permanent resident of Village Lailunga, Ward No. 5, High School Colony, Police Station and Tehsil Lailunga, District Raigarh, is duly registered with the employment exchange and possesses valid resident, caste and identity certificates issued by the competent authorities. He is adequately qualified, having passed High School (10+2) in the year 2004, Higher Secondary Examination in 2006, obtained a graduation degree in 2009, and thereafter acquired a Post Graduate Diploma in Computer Applications in the year 2015. The petitioner’s father, Late Shri Nand Lal Manjhi, was a regular employee under the respondent department and rendered unblemished service until his death in harness on 29.12.2016, which fact is duly supported by the death certificate and service certificate issued by the respondent authorities. Upon the demise of his father, the petitioner, being a dependent family member, submitted an application dated 15.02.2016 seeking compassionate appointment in accordance with the applicable government policy, along with all requisite documents. The petitioner’s family consists of his widowed mother, who is dependent upon him, his wife and children, as reflected in the ration card issued by the competent authority. Subsequently, the respondent authority, vide letter dated 09.05.2016, sought certain clarifications and additional documents, including an affidavit regarding employment status of family members, which were duly furnished. Despite the same, the petitioner’s case was not decided, compelling him to approach this Court by filing WPS No. 5190/2022, which was disposed of on 02.08.2022 with a direction to the respondents to consider his claim within a stipulated period. In compliance thereof, the petitioner again submitted a representation on 08.09.2022.
