1. Heard Mr. Sanjay Kumar Gupta, applicant, appearing in person as well as Mr. Kashif Shakeel, learned counsel for the respondents.
2. This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996 (for short, the Act of 1996) for appointment of an Arbitrator.

At the outset, Mr. Sanjay Kumar Gupta, applicant appearing in person submits that earlier, he had filed an application under Section 11(6) of the Act of 1996 for appointment of an Arbitrator, which was registered as ARBR No. 16/2024. In the said arbitration request, the facts involved therein, is quoted herein below:
“3. The fact, in brief as projected is that vide agreement / work order No. GM(Mines-IO&F) / IOC/ Raj/ CC-18/ AL- 26(13-14)/ 482 dated 13.06.2013 (Annexure P-9) entered into between the petitioner and the respondent, with respect to hiring of dump truck of capacity 16T for transportation of Dolomite ROM from mines to surge pile/dump yard at Hirri Mines, and General Conditions of Contract (for short, the GCC) applies, therefore according to clause 93 of the GCC (Annexure P-19) that any dispute between the parties has to be resolved by arbitration and the same is submitted by respondents in para 4 of their reply with copy of GCC as Annexure-R-2 and 3-2 in WPC 4585 of 2022 (Annexure P-
18) and the same is again reiterated in WA 82 of 2024, and the same has been directed by Honble Court in para 7 and 8 of the judgment dated 18.03.2024. It was agreed that in case any difference arising in respect of the contract entered, a reference shall be made to an arbitrator to be appointed to resolve the disputes between parties. The respondents prayed before a Division Bench of this Honble Court in Writ Appeal No 82/2024 that they are ready to resolve the issue by arbitration as appellant/writ petitioner has alternate remedy in the form of Arbitration to resolve the dispute and it appears from the paragraph 4 of the return filed by respondents in the writ petition bearing WPC No.
4585 of 2022 (Annexure P-18 and P-19).

According to Mr. Gupta, appearing in person, since there exists a dispute between the parties, he has sent many notices / e-mails to seek alternate remedy of arbitration to the respondent to appoint any arbitrator by the consent of the parties. As the respondents have failed to appoint any arbitrator in terms of the agreement/ work order as submission made in the Honble Court on date 18.03.2024, the applicant has filed this arbitration request.”
