1. Challenge in this Writ Petition is to the order dated 08.02.2023

passed by Respondent No.2 in Panchayat Appeal Case

No.202111960100022/B-121/2021-22, whereby Respondent No.2

has dismissed the appeal filed by the appellant/petitioner herein

and affirmed the order dated 28.10.2021 passed by Respondent

No.3 (Annexure P/7).

2. The petitioner has prayed for the following reliefs:-

10.1 That, this Hon'ble Court may kindly be pleased

to issue an appropriate writ/ order, thereby setting-

aside/ quashing the impugned order dated

08.02.2023 Annexure P/1 and further be pleased to

direct the respondent authorities to issue

appointment order in favour of petitioner on the post

of Anganbadi Worker for Anganbadi Centre,

Jharnapra, Tahsil-Baikunthpur, District-Korea being

meritorious candidate, in accordance with law.

10.2 That, any other relief/order which may deem fit

and just in the facts and circumstances of the case

including award of the costs of the petition may be

given.

3. By the order impugned, appeal preferred by the petitioner has

been dismissed and the order passed by the Respondent No.3

was affirmed by which, prayer of the petitioner for cancellation of

evaluation chart prepared by the selection committee had been

rejected.

4. Necessary facts of the case are that the respondent authority

issued an advertisement for appointment on the post of

Anganbadi Worker for Anganbadi Centre, Jharnapara, Janpad

Panchayat, Baikunthpur. It is submitted that the State Government

has issued guidelines/ rules dated 02.04.2008 for appointment on

the post of Anganbadi Worker and in Clause 1.5 of the guidelines,

it is specifically prescribed that the candidate must be the resident

of particular Gram Panchayat and the candidate must be submit

the residential proof certificate issued with joint signature of

Sarpanch and Secretary of concerned Gram Panchayat. That, the

petitioner who is having 10 years experience on the post of

Anganbadi Assistant and being permanent resident of Gram

Panchayat, Jharnapara, duly applied for appointment on the post

of Anganbadi Worker at Gram Panchayat, Jharnapara along with

all eligibility documents. It is noteworthy to mention here that the

respondent no. 8 is the permanent resident of Juna Para, Nagar

Palika Ward No. 16, Baikunthpur, which is evident from the Adhar

Card, Voter List, list of Ration Card Holder of Ward No. 16, Pt.

Jawahar Lal Nehru Ward, Baikunthpur and the certificate issued

by the Gram Panchayat, Jharnapara. That, the said respondent

no. 8 is not the permanent resident of Gram Panchayat,

Jharnapara, therefore she is not eligible fo
