Issue notice.

Learned State Counsel accepts notice on behalf of

respondent Nos.1 to 3, hence, process fee is not required to

be paid for issuance of notice to these respondents. He

prays for and is granted three weeks time to file reply.

On petitioner’s depositing process fee as per rules,

notice to issued to respondents No.4 to 7, making it

returnable in three weeks.

Also heard on I.A. No.1/2026, application for grant of

interim relief.

Learned counsel for petitioner submits that

respondents No.4 to 7, who are juniors to petitioners in

cadre, have been sent for pre-promotional training,

depriving right of petitioners for consideration of their

promotion.

Learned State Counsel submits that according to the

Rules, minimum service/experience in feeder cadre for a

direct appointee on the post of Sub-Inspector

(Telecommunication), for consideration of his promotion, is

08 years and for a promoted Sub-Inspector (Radio), it is five

years. Respondents No.4 to 7 are holding post of Sub-

Inspector (Telecommunication) after promotion and they

have completed requisite period of qualifying service in

feeder cadre, whereas, as per instructions received by him,

petitioners, who are direct appointees, have not completed

08 years of qualifying service in feeder cadre and therefore,

they are not eligible for promotion.

Learned counsel for petitioners submits that as per

policy of the State Government, the employees who are

serving in scheduled area continuously for four years, are to

be granted relaxation of one year in qualifying service for

consideration of their names for promotion. Petitioner

having served in scheduled area for continuously four

years, are entitled for relaxation and as such, they are

entitled for consideration for their promotion.

Learned State Counsel submits that he will also file

reply to application for grant of interim relief.

On due consideration of submissions of learned

counsel for respective parties, purely as an interim

measure, the respondent authorities are directed not to

issue any order of promotion to the post of Inspector

(Telecommunication) till next date of hearing.

List this petition in the week commencing 23.2.2026.
