ORDER ON BOARD

1. Petitioner has filed this writ petition seeking following reliefs.

“10.1) That, this Hon'ble Court may kindly be pleased issue appropriate writ or order or direction against the respondents state authority to issue last pay certificate (LPC) of the petitioner and the petitioner to be provided salary from month of November, 2024 to till date with 18% interest.

10.2) That, this Hon'ble Court may kindly be pleased issue appropriate writ or order or direction against the respondent No. 1 to take punitive action against the respondent No. 4 and 5 after conducting duly inquiry for not issuance of LPC of the petitioner.

10.3) Any other relief which this Hon'ble Court deems fit and proper may also be granted in favour of the petitioner with cost of petition.”

2. Learned counsel for petitioner submits that petitioner was promoted on the post of Principal and posted at Shashidhar Panda Government College, Saria, District Sarangarh vide order dated 04.11.2024. Petitioner gave her joining on 05.11.2024 and since then she is working on the promoted place of posting. However, since November 2024, till date, petitioner has not been paid salary and even last pay certificate has not been sent to the transferred place of posting. Petitioner initially made oral request to the concerned authorities and lastly she submitted representation before Respondent No. 1 as also before Respondent No. 2 on 06.12.2025, however, till date no decision has been taken and therefore direction be issued to concerned authorities to take decision on the representation of petitioner at the earliest.

3. Learned State counsel submits that he is having no objection to the limited prayer made by learned counsel for petitioner. He further submits that appropriate authority in the facts of the case and nature of grievance raised by petitioner would be Respondent No. 2.

4. On due consideration of the submission made by learned counsel for the respective parties, nature of grievance raised that she has not been paid salary since November 2024 till date against which she has made representation before Respondents No. 1 and 2, without entering into merits of the case, this writ petition is disposed of directing respondents no. 1 & 2 to take decision on the pending representation submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of 02 weeks from the date of receipt of copy of order passed by this Court.

5. Accordingly, this writ petition is disposed of with the aforesaid observation and direction.
