1. Petitioner has preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :-

i. Issue an appropriate writ, order or direction, including a writ of certiorari, quashing and setting aside the recovery letter dated 14.01.2026 issued by Respondent No. 5, whereby a sum of ₹4,09,37,089/- has been demanded from the Petitioner.

ii. Issue an appropriate writ, order or direction restraining the Respondents from invoking, encashing or otherwise acting upon the Bank Guarantees furnished by the Petitioner as performance security pursuant to the Custom Milling Agreements for KMS

2023-24 and KMS 2024-25.

iii. Issue an appropriate writ, order or direction directing the custom milling operations in accordance with applicable Government policy and not to obstruct performance under the subsisting Custom Milling Agreements.

iv. Issue an appropriate writ, order or direction directing the with law for participation in subsequent Kharif Marketing Seasons, including KMS 2025-26, without being prejudiced by the impugned recovery proceedings.

V. Pass such other and further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.

2. Learned counsel for the petitioner submits that, after filing instant writ petition, fresh order has been passed by the respondent No. 3/Marketing Federation, which is required to be challenged, therefore, he seeks permission to withdraw this writ petition with liberty to file a better constituted petition challenging subsequent order.

3. Learned counsel for the respondents do not oppose the above submission.

4. As prayed by learned counsel for the petitioner, this writ petition is dismissed as withdrawn with the liberty as sought for.

5. Interlocutory application(s), if any, stands disposed off.
